2. The nature and kind of data processed
Fendi collects and processes personal data voluntarily provided by user upon interaction with the Site functionalities and request of the services offered by the Site, for example when user subscribes to the Site, to the newsletter and mailing list, purchases Fendi products, takes part in initiatives realized through the Site, requests information and services or sends communications to Fendi. The foregoing also applies to other Web sites, mobile and Internet applications of Fendi or of related companies subject to joint control, and to data provided by the user during the interaction with the shops of the Fendi world managed by Fendi or by its affiliated and companies subject to joint control ('Fendi companies'), for example data provided by filling out customers postcard in the shops or in the course of informal talks during visits to the stores. As permitted by the Privacy Code, Fendi may also process user’s personal data obtained from third parties in the course of its business activity and with the user’s consent, Fendi may further process user’s personal data for survey and market research purposes, for profiling purposes, for marketing and promotional purposes. The Fendi companies acting as data Controllers even outside of the European Union will use data for the same purposes. For more information on the processing purposes please refer to section 3 below.
Fendi may collect the following information: name, sex, place and date of birth, nationality, e-mail. While purchasing through the Site, other information are required such as identification codes (eg tax code, VAT number), contact information such as address, phone number, and other information of an optional nature. When personal data are collected on the Site a specific informative statement will be displayed according to Art. 13 of the Privacy Code. User’s consent is requested when necessary under the Privacy Code. If user provides Fendi with personal data of third parties (for example in case of use of the functionality ‘send to a friend’ that allows user to send information on the Site and Fendi products and initiatives to a friend) user shall provide that said communication to Fendi and its processing for the purposes specified in the relevant privacy statement are in compliance with the Privacy Code and applicable legislation, so for example user may provide third parties’ data only after having duly informed them and having obtained their consent if requested by the Privacy Code.
3. What are the purposes and how Fendi processes personal data; the nature of data provision and the consequences in case of refusal
In addition to the so-called surfing data (please refer to section 2 above) Fendi may process the personal data voluntarily provided by user when user interacts with the Site functionalities and asks for services of Fendi. Fendi will process user’s personal data for the following purposes: managing the subscription to the Site, newsletter or mailing list, managing the purchase of products through the Site (which includes all activities pertaining to the sale and after-sale services, such as for example administrative and accounting activities, fraud prevention, managing of returning items, guarantee, customer support, interaction with Fendi customer service), managing the participation in promotions and other initiatives organized through the Site, to reply to and to manage user’s request for information, questions, communication or feedback to Fendi. User’s personal data will also be processed by Fendi to comply with obligations imposed by laws, regulations and Community legislation (including money laundering legislation) and to establish or defend a legal claim of Fendi.
For the purposes described above, the conferment of personal data of the user is necessary, and any refusal would prevent Fendi from performing its contractual obligations and providing services and goods to the user. User will not be able to use the features of the Site and to obtain the required information, as mentioned above. Furthermore, user will be able to unsubscribe to the dedicated area MyFendi at any time by logging into the personal area "My Profile".
With the user’s consent, Fendi may also process user’s personal data for survey and market research purposes, for profiling purposes, for sending to user, also through e-mail, sms and mms of promotional information and material on products of Fendi and Fendi companies, for special initiatives on prices and promotions of Fendi and Fendi companies and for initiatives such as events, exhibitions and fairs organized by Fendi and Fendi companies or that they participate in, including relevant invitations, as applicable. User will always have the opportunity to refuse receiving promotional e-mails; in each communication it will be explained how to refuse receiving future promotional e-mails.
For the purposes described above, the conferment of personal data by the user is optional and any refusal does not affect the performance of contractual obligations of Fendi, the provision of services to the user, the delivery of products required or the possibility to use the features of the Site and obtain the required information. Fendi will not, however, inform the user on promotional initiatives and events mentioned above and will not be able to consider the preferences of the user.
Fendi processes personal data mostly through electronic and automated means whose procedures and logics are defined according to the purposes herein specified. Data may also be processed in paper form. Fendi keeps data only for the time that is necessary to fulfill specific purposes that are sought from time to time.
